Letting your Spanish property to holidaymakers carries an obligation to report your guests to the authorities, either the Guardia Civil or the Policía Nacional depending on the region. It applies to all forms of tourist letting and is separate from your licence and your tax obligations.
What the duty involves #
As the person letting the property you pass guest details to the Spanish authorities. It applies to every guest, the report is due within 24 hours of arrival, and it is submitted digitally through an official system.
The purpose is to maintain a record of who is temporarily in the country.
What you have to collect #
Per guest: full name, date of birth, nationality, the type and number of the identity document, and the dates of arrival and departure.
Since the rules were expanded at the end of 2024 the data set is considerably larger than it used to be, and now includes payment details and the relationship between guests where relevant. If you set your process up before then, it needs revisiting.
On arrival you complete a registration form with the guest and then enter the data into the system.
Registering yourself first #
Before you can report guests you have to register as a provider. You do that with the police or the Guardia Civil and receive login credentials for the system.
There are also platforms that automate the process and connect it to your bookings, which is worth considering if you let regularly. Doing this manually within 24 hours from another country gets old quickly.
If you do not comply #
The obligation is actively enforced. Fines run to thousands of euros and checks are more frequent in tourist areas. Failing to register counts as a breach of the tourist letting rules, which can also put your licence at risk.
Practical points #
Register as a provider as soon as you have your letting licence rather than when your first guest arrives. Always check a valid identity document on arrival. Report within the deadline. And keep the data and forms for at least three years.
If you use a letting partner, confirm in writing that they handle this. Do not assume it is included.
