Do you always need a lawyer in Spain?

The short answer: no, it is not compulsory. In practice it is close to essential.

The notary in Spain has a different role from a UK conveyancing solicitor, which leaves a large part of the checking with you as the buyer. That gap is what a lawyer fills.

What the notary does, and does not do #

The notary handles the official transfer. They verify the identity of buyer and seller, check the title documents and make sure the deed is correctly executed.

What they do not do is any detailed substantive checking. The notary does not confirm whether there are debts attached to the property, whether it was built legally, or whether the permits are in order. That is your responsibility.

What a lawyer does #

A lawyer looks at everything you cannot see, which is where the risk actually sits. This is the due diligence: ownership and registration through the nota simple, any mortgages, debts or charges, building permits and legality, outstanding community fees, and any live legal proceedings.

Beyond that, a lawyer reviews the contracts, handles the payments, and deals with the seller and agent. In short, they make sure you are not buying a problem.

The risks of going without #

Without legal representation you take on risks that are larger than they look. A property that is partly unauthorised. Debts that transfer to you automatically. Contracts that are incomplete or one-sided. Disputes with the community or the local council.

These usually surface after the purchase, at which point it is too late.

Choosing one #

Not every lawyer is the right one. Use someone independent, not introduced by the seller, and preferably with experience of foreign buyers. Ask about fees up front, which are typically around 1 per cent of the purchase price. Have every contract reviewed before you sign.

And if you are buying remotely, a lawyer can act for you under a power of attorney.

A lawyer is not a legal requirement in Spain, but they are your main source of certainty. Look at it this way: you are not buying a house, you are buying a legal situation, and that situation has to be sound.
